kru2u reserves the right to amend these Terms and Conditions from time to time without prior notice to reflect changes made to the operation of the Website. Whilst we will make every reasonable effort to notify you of any changes to these Terms and Conditions, you are advised to check these Terms and Conditions periodically to update yourself on any changes and apprise yourself of the then current Terms and Conditions applicable to your membership and use of this website.
A. APPLICATION OF KRU2U’S TERMS AND CONDITIONS
1.You agree that these Terms and Conditions contained herein including the Privacy Policy governs your use of:
– all sales on KRU2U
– your purchase of products, merchandise and/or tickets from the KRU Group.
2.By using our website, you acknowledge that you have read, understand and agree to the Terms and Conditions and the Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference.
3. If you do not agree to be bound by these Terms and Conditions, please refrain from making purchases from our website.
B. PHYSICAL PRODUCTS
1. Colours
We have done our best to reproduce as accurately as possible the colours of the Products shown on this Website. However, because the colours you see on the Website will depend on your monitor, we cannot guarantee that your monitor’s reproduction of any colour will be accurate.
2. Correction of Errors and Inaccuracies; Limitations on Quantity
Whilst we will make every reasonable effort to present accurate information on this Website, the information may contain typographical errors or inaccuracies and may not be complete or current. Neither kru2u nor any third party or data or content provider makes any representations or warranties, whether express, implied in law or residual, as to the accuracy, completeness or reliability of information, opinions, any company information, news, research information, data and/or content contained on this Website (including but not limited to any information which may be provided by third party or data or content providers) (“Information”) and shall not be bond in any manner by any Information contained on this Website. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update Information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability.
3. Indemnification
You shall indemnify and hold kru2u and its affiliates , and their respective employees, representatives, agents, affiliates, directors, officers, managers and shareholders (collectively the “Parties”) harmless from any damage, loss, or expense (including without limitation, attorneys’ fees and costs) incurred in connection with any third-party claim, demand or action (“Claim”) brought against any of the Parties alleging that you have breached any of these terms and conditions. If you have to indemnify any of the Parties under this Section, kru2u shall have the right to control the defence, settlement, and resolution of any Claim at your sole expense. You may not settle or otherwise resolve any Claim without express written permission from kru2u.
4. Legal Capacity To Transact
By accepting these Terms and Conditions you represent and warrant that you are over the age of eighteen (18) years. If you are under the age of eighteen (18) years you cannot place orders on this Website. Should kru2u suffer any damage or other losses as a result of a transaction entered into by a minor, kru2u reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed on this Website.
5. Placing Your Order
You may place an Order by adding items to “My Cart” on the Website and clicking the “Check Out” button. When you place your Order, we will issue you with an Order Number. By placing an Order, you make an offer to us to purchase the Products you have selected based on the Terms and Conditions applicable at the time of purchase. Information contained on this Website constitutes an invitation to treat. No information on this Website constitutes or should be deemed as an offer by us to supply any Products to you, however kru2u will make every effort to supply Products to you.
6. Delivery of Your Products
Delivery will be made via Pos Laju. We charge shipping and handling for each Order. You will receive an email with the tracking number once your package has been sent out. You shall be responsible for checking the delivery status of your products. In the event that your Product is returned due to non-delivery arising from incorrect address provided / unable to complete delivery / or any other reason, you wll be responsible for any additional postage charges to resend your Products.
C. WETLAND STUDIOS PUTRAJAYA (WSP) TICKETS
Tickets are issued by KRU Studios Sdn Bhd (KSSB) and are subject to the following terms and conditions as follows:
1.To use WSP’s Online Ticketing services via KRU2u, you must be at least 18 years old or above as of the time of your ticket purchase. If you are under 18 years old, you must only use WSP’s Online Ticketing services under the supervision and with the consent of your parent or legal guardian.
2.As stated on the website, ticket prices differ based on the age and nationality of patrons. For ticket pricing purposes, the following definitions shall apply:
2.1As of the date of entry to WSP:-
2.1.1Adults are individuals between the ages of 13 to 64 years old;
2.1.2Senior citizens are 65 years old and above;
2.1.3Children are between the ages from 4 to 12 years old;
2.2Malaysians are individuals carrying MyKad, MyTentera and MyKid cards only;
2.3Foreigners are individuals with foreign passports or carrying MyPR and MyKAS cards.
The admission for all infants aged 3 years old and below as of the date of entry to WSP is FREE, subject to the verification of MyKid (for Malaysians) and passport (for foreigners).
3.All prices quoted are in Ringgit Malaysia (RM). Prices are subject to change without prior notice.
4.You agree to provide true, accurate, and complete details asked in WSP’s online customer information.
5.You shall not impersonate or attempt to impersonate any other person by using the name, address, credit card information, or e-mail address of any other person for any reason whatsoever, without prior consent or forge a header or otherwise manipulate identifiers to disguise the origins of an e-mail.
6.All fields in the ‘Billing Details’ page are mandatory and therefore you are required to fill in all fields with true, accurate, and complete personal information about you and persons you intend to bring as patrons (if any) to WSP. You are also required to update the information from time to time for KSSB to serve you better.
7.It is your responsibility to check the information provided by you in respect of the Online Ticket(s) to be purchased are accurate before completing the transaction. Please be reminded to check the number/type of Tickets and the Visiting Date as the Online Ticket are only valid for entry on the Visiting Date stated on Online Ticket. All Purchases are FINAL. Any error or inaccurate information provided by you may result in you incurring additional charges or possible notification by us to declare the transaction null and void.
8.A confirmation email will be sent to you after the successful transaction of the ticket purchase.
9.Online Ticket(s) shall be purchased a minimum of 24 hours before your visit to WSP to facilitate the smooth process of your transaction. Failure to do so may result in the need for you to purchase the ticket at our physical ticketing counter at WSP.
10.The information, materials, functions, and contents provided in this website and online ticketing system may be changed from time to time with or without notice at KSSB’s absolute discretion. Your continued access or use of the online ticketing and/or the services provided herein after any such change will be deemed as your acceptance of those changes.
11.Upon the purchase of the ticket, you shall agree to the terms and conditions outlined herein.
12.The ticket is the proof of purchase for entry to WSP and must be presented at the time of admission.
13.At the point of entry, for verification purposes you may be required to provide personal identification documents such as MyKad, MyTentera and MyKid for Malaysians and/or passport, MyPR, and MyKAS for foreigners;.
14.Patrons purchasing tickets under the disabled person category must provide documented evidence of disability at the point of entry at WSP. The documented evidence is defined as Kad OKU issued by the Department of Social Welfare for Malaysians and, the equivalent document issued by the respective foreign government for foreigners.
15.The ticket has one-day and single-entry validity and is not reusable for multiple entries.
16.The ticket must not be duplicated to falsify entry and the holder will be refused admission in the event of such occurrence.
17.The ticket excludes any other businesses or services including but not limited to SkyDreamVR, Photo Services, Guided Tour, Food & Beverages, and Souvenirs in WSP.
18.Defaced or altered tickets will become void and the holder will be refused admission.
19.Tickets cannot be resold for commercial gain. If we have reason to believe that tickets have been re-sold, they will be invalidated, and the holder will be refused admission.
20.KSSB reserves the right not to honour any online sales transaction if we have reason to believe that the transaction is fraudulent and if you have failed to provide accurate and complete information at the time of entry.
21.Please be reminded that at the point of entry, KSSB reserves the right to demand for additional payment from you for any difference in admission fee of tickets purchased online arising from the incorrect declaration based on the various categories such as nationality, age and disability.
22.Nobody will be allowed admission to WSP without a valid ticket.
23.No exchange, refund, or replacement will be made under any circumstances. No cancellation will be accepted upon confirmation of purchase. Refund shall only be provided based on the occurrence as stated in items 24 and 25 below.
24.In the event of technical malfunction and/or to address the safety issue, we reserve the right to suspend entry to the exhibitions and reschedule, change, or cancel the entry. If you disagree with a new entry time or date proposed by us, KSSB shall provide a full refund to you however shall not be held responsible for any costs that you may incur for travel, accommodation, and other forms of compensation.
25.If the park is closed on the scheduled ticket date due to unforeseen circumstances, patrons are allowed to request for change of date.
26.We reserve the right to alter or vary the content of the exhibition or performance timing (if any) in circumstances beyond our reasonable control and without any obligation to make any refunds or exchange tickets.
27.For the safety of the patrons at WSP, we reserve the right to refuse admission and conduct security searches as we deem appropriate.
28.In the interest of our patrons’ safety who are already at the exhibition area, we may from time to time suspend entry for our patrons who have yet entered the exhibition hall for us to manage the flow of visitors and to ensure we remain compliant with visitor density requirements. If the area at our indoor ticketing counter is fully occupied, you may be required to wait at WSP’s outdoor space, regardless of weather conditions until the patrons can be accommodated indoors.
29.We reserve the right to refuse admission or to remove from the premises any person appearing to be intoxicated, under the influence of drugs, showing signs of Covid-19 including a high temperature or a persistent cough, refusing to wear a mask when required to do so (unless they are unable to do so due to an underlying health condition), otherwise behaving dangerously or inappropriately, or for any other behaviour likely to cause damage, injury, nuisance, and annoyance or for failure to comply with reasonable requests made by KSSB.
30.KSSB is not responsible for any loss, damage, death, or injury of the patrons howsoever caused and/or due to the patron’s actions and negligence. Any mishaps and/or accidents at the premises beyond the control of KSSB shall be compensated to you solely by our insurance coverage upon completion of the investigation.
31.KSSB does not accept any responsibility for any loss or damage to personal property brought to WSP.
32.You shall be responsible to compensate KSSB for any damages or loss of our assets, facilities, or temporary and/or permanent structure caused by you or the children under your care based on the video evidence recorded through our closed-circuit television system.
33.For the avoidance of doubt and in the event of a dispute, KSSB’s liability to you is limited to the value of the purchased ticket(s) only.
34.Patrons may be filmed, photographed, or sound recorded for broadcast, and publication in physical and digital formats for publicity and security purposes whilst at WSP.
35.Patrons may take photographs, record video, and audio at WSP based on the condition that the use of the photographed and recorded content is for private and non-commercial use only.
36.Patrons are not permitted to bring animals to WSP.
37.KSSB’s management reserves the right to substitute, amend or terminate any offers or promotions at any time without prior notice.
38.All the following uses of this website are prohibited and may constitute a criminal offense (s):-
38.1The resale of Online Tickets to any third party;
38.2Use of Online Tickets for any purposes that are unlawful or contrary to the Online Ticketing Terms and Conditions;
38.3Use the Online Ticketing Services in any manner that could damage, disable, overburden, or impair WSP’s Online Ticketing Services or interfere with any other WSP’s patrons and clients’ use of the website;
38.4Attempt to gain unauthorized access to any account, data, computer systems, or networks associated with the Online Ticketing Services; or
38.5Obtain or attempt to obtain any materials or information through the Online Ticketing Services or by any means not intentionally made available or provided for by WSP.
39.KSSB shall not be responsible or liable for any damages (whether direct, indirect, special, or consequential), late or non-delivery of tickets, loss, embarrassment, and/or reputational damage under the circumstances including but not limited to the following:
39.1The online ticketing service is not available on the KSSB website during the intended time of purchase;
39.2The email address provided by you is incorrect;
39.3Your refusal to enter the WSP premise at the stipulated date and time published in your ticket. Should such an occurrence happen, the ticket purchase is considered delivered and no refunds will be made;
39.4Any inability to access or use the online ticketing service and/or any other website linked to WSP online ticketing service;
39.5Any failure, delay in transmission, interruption, error, omission, or breakdown of any equipment, system, server software, or terminal at WSP or the payment gateway;
39.6Attacked or interfered with by any computer virus, corruption, worms, or by any person;
39.7Improper use or unauthorized use of this online ticketing system;
39.8To comply with any special request and/or instruction made by you other than the standard admission to the exhibition hall for patrons at WSP;
39.9Any inaccuracy, error, and/or defect of any content published on other websites linked to WSP’s online ticketing system;
39.10Any malfunction or defect of your computer terminal, system, or software used in accessing WSP’s website and online ticketing system;
39.11The alteration and/or removal of data and/or information provided by you on KSSB’s website and/or KSSB’s affiliated websites;
39.12When addressing any safety, technical, maintenance, crowd control, and/or any circumstances beyond KSSB’s control.
39.13Natural disaster, violence, warlike situations, and/or reasons beyond KSSB’s control;
40.We reserve the right to terminate or suspend your access to WSP’s Online Ticketing Service or any part thereof at any time without notice for any breach of terms and conditions.
41.KSSB may vary, update or change these Online Ticketing Terms and Conditions at any time at its sole discretion without prior notice. Any variation, updates, or changes will be posted on WSP’s website. Your continued access to or use of WSP’s Online Ticketing service after any such changes shall constitute your consent to such change.
D. OTHER ITEMS
1.Our Liability
In no event shall kru2u and any of its affiliates be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect, special, incidental or consequential loss or damage of any kind including but not limited to loss of use, loss of data, loss of business or profits, howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
2.Force Majeure
Neither kru2u nor any of its affiliates shall be liable for any failure or delay in performing any of its obligations under these Terms and Conditions if such failure or delay is caused by circumstances beyond their reasonable control and we shall be entitled to a reasonable extension of time for the performance of such obligations.
3.Entire Agreement
These Terms and Conditions together with your Order constitute the entire agreement between you and kru2u in relation to your use of the Website and the supply of the Products to you by kru2u. These Terms and Conditions cannot be varied except by us in writing or by e-mail. Neither you nor kru2u shall be bound by any express, tacit or implied representation, warranty, promise or the like not recorded herein. Unless specifically stated these Terms and Conditions supersede and replace all prior commitments, undertakings or representation, whether written or oral, between you and kru2u.
4.Modification/Alteration
We may at any time modify any relevant Terms and Conditions, policies or notices. You acknowledge that by visiting the Website from time to time, you shall become bound to the current version of the relevant Terms and Conditions (the “current version”) and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the Website.
5.Miscellaneous
These Terms and Conditions are binding upon the parties and their respective successors and permitted assigns.
These Terms and Conditions will not be assignable or transferable by you without our prior written consent.
The invalidity or unenforceability of any provision of these Terms and Conditions will not affect the validity or enforceability of any other provision of these Terms and Conditions, all of which will remain in full force and effect.
6.Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia without giving effect to any principles of conflict of law, and any disputes arising in connection with this Website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith shall be subject to the non-exclusive jurisdiction of the courts of Malaysia.
